Terms and Conditions

1. Definitions

Company: Rayleigh Gutter Cleaning and Repairs, a provider of gutter cleaning, repair, replacement, and related services.

Client: The individual, household, or business entity who requests and pays for the Company’s services.

Services: Gutter cleaning, gutter repairs, gutter replacements, fascia and soffit cleaning, conservatory roof cleaning, Aco drain & gully cleaning, or any related service as agreed upon between the Company and the Client.

Agreement: The contract formed between the Company and the Client for the provision of Services, as detailed in a written quote, invoice, or confirmed booking.

2. Acceptance of Terms

By requesting and accepting the Company’s services, the Client confirms they have read, understood, and agreed to be bound by these Terms and Conditions.

3. Service Provision

  • The Company will provide the Services as outlined in the written quote, invoice, or confirmed booking.

  • Any changes to the agreed scope of work must be confirmed in writing by both parties.

  • The Client is responsible for ensuring clear and safe access to the work area for the Company’s personnel and equipment.

  • The Company reserves the right to refuse, postpone, or cancel Services due to unsafe working conditions, including adverse weather, health and safety risks, or restricted access.

  • All waste materials resulting from the cleaning, repair, or replacement of gutters will be removed and disposed of responsibly by the Company, unless otherwise agreed.

4. Payment

  • Domestic Clients: Payment is due within 24 hours of completion of the work, unless otherwise agreed in writing.

  • Commercial Clients: Payment is due within 28 days of receipt of the invoice.

  • Accepted forms of payment include debit and credit cards, BACS, and cash.

  • Late Payment Policy

If payment is not received within the stated timeframe, the Company reserves the right to charge interest at 4% above the Bank of England base rate until payment is made in full. In addition, reasonable costs incurred in recovering overdue amounts (such as debt collection fees or legal costs) may also be charged to the Client. Continued failure to pay may result in suspension of further services until the account is settled.

5. Warranty Gutter Replacements

  • Manufacturer’s Guarantee: All new gutter replacements supplied and installed by the Company are covered by a 10-year manufacturer’s warranty from FloPlast, including a 10-year performance guarantee on rainwater systems.

  • Workmanship Warranty: The Company provides a 10-year warranty against workmanship defects on gutter replacement installations.

  • Conditions: To keep the workmanship warranty valid, gutters must be professionally cleaned and maintained annually by the Company, at a cost to the Client. Proof of annual servicing will be recorded by the Company.

  • Exclusions: These warranties do not cover damage caused by:

    • Failure to have annual maintenance carried out by the Company.

    • Extreme weather events (e.g. storms, high winds, snow, ice).

    • Accidents, neglect, or third-party interference.

    • Structural defects or issues with the property beyond the Company’s control.

Repairs & Other Work

  • Gutter repairs are covered by a 12-month workmanship warranty, provided gutters are properly maintained. Gutter repairs are covered by a 12-month workmanship warranty, provided gutters are properly maintained. This warranty only applies to the specific area repaired by the Company. If the Client’s existing guttering system has been installed incorrectly by a previous contractor, is defective, or in poor overall condition, this may impact the effectiveness or longevity of the repair. The Company cannot be held responsible for failures or issues arising from guttering outside the specific repair area or for defects beyond its control.

  • Gutter cleaning services carry no warranty, as conditions can change immediately after cleaning.

6. Liability

  • The Company is not liable for pre-existing damage to gutters, fascias, soffits, rooflines, or surrounding property.

  • The Company will exercise reasonable care during services but is not responsible for minor damage to landscaping, garden features, or other property where such damage is a foreseeable result of normal service operations.

  • The Client must notify the Company in advance of any underground utilities, fragile areas, or potential hazards they are aware of.

  • The Company will not be liable for consequential losses such as internal water damage, structural issues, or property defects beyond its direct control.

7. Cancellation Policy

  • Gutter cleaning services: Clients may cancel without penalty by providing at least 48 hours’ notice before the scheduled appointment.

  • Repairs, replacements, or services requiring materials: If the Client cancels after materials have been ordered, they will be charged for those materials. Cancellations made at least 5 days before the appointment may be exempt from this fee, at the Company’s discretion.

  • Cancellations made with less than 48 hours’ notice may incur a cancellation fee.

  • These terms do not affect your statutory rights under UK consumer law.

8. Disputes

  • Any disputes will first be addressed through good faith negotiation.

  • If a resolution cannot be reached, disputes may be referred to mediation or arbitration.

  • Either party reserves the right to pursue a claim through the small claims court where appropriate.

9. Changes to Terms and Conditions

The Company reserves the right to modify these Terms and Conditions at any time. Updates will be posted on the Company’s website and will take effect immediately upon posting.

10. Governing Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales.
